Terms of Use

The short version. nanafeed is a free app where you post photos and ratings of bananas you bought. Your posts stay yours; you let us show them in the app, and we use them, in aggregated and anonymised form, to describe how bananas taste and sell in different shops. Every price, rating and ripeness score is one user's own observation — we do not verify it. nanafeed is run by Bananiv GmbH, a banana importer (see section 1). Be honest, be decent, post only real bananas. You can delete your account at any time in the app.
1. Who we are — and our interest in bananas
nanafeed is operated by Bananiv GmbH, Lyoner Straße 15, 60528 Frankfurt am Main, Germany, registered at Amtsgericht Frankfurt am Main, HRB 141533 ("nanafeed", "we", "us"). Full legal notice: nanafeed.io/impressum.
Please note: Bananiv GmbH also imports bananas, sells them under its own brand "Bananiv" and supplies retailers. Bananiv bananas can therefore appear in nanafeed next to other brands. To keep the rankings independent:
- The Bananiv brand does not take part in any brand ranking. Posts about Bananiv bananas stay in the feed, but Bananiv is never ranked against other brands.
- Posts and ratings by Bananiv people — our owner, staff, contractors, their close family and our test accounts — stay in the feed but are not counted in any ranking, average or index.
- We never change, remove or weight user ratings to favour or harm any brand or retailer.
From app version 1.0.1, accounts of Bananiv people are marked as such in the app.

2. Our agreement and changes to it
By creating an account you enter into a free-of-charge user agreement with us on these Terms. Our Privacy Policy explains how we handle personal data; it is information, not part of this agreement.
We may change these Terms where this is needed because the law or a court or authority decision changes, because we add, change or remove a feature, or to close a gap or clarify wording — and only if the change is reasonable for you. We will tell you about any change in the app at least 30 days before it takes effect, together with your right to object and what happens if you do not.
- Changes that affect the core of our agreement (what the service is, the licence you give us, liability) take effect only once you actively accept them in the app.
- Other changes take effect after the 30 days unless you object in the app or by email before then. If you object, the previous Terms continue to apply to you; we may then end the agreement under section 12.
3. Who can use nanafeed
You must be at least 16 years old, or the age of digital consent in your country if higher. If you are under 18, you confirm that a parent or legal guardian has agreed to these Terms. nanafeed is not directed at children under 16. One person, one account. Keep your login secure; you are responsible for activity under your account unless you are not at fault for it.
4. The service
nanafeed is free. We offer it as it currently is and may add, change or remove features. We aim for the app to be available, but we do not promise uninterrupted availability — maintenance, updates and outages of our providers can interrupt it.
5. Your content
"Content" means anything you post: photos, ratings, ripeness and taste scores, prices, comments, stickers, the store, city and point on the map you select as the place of purchase, and "Also tasted" confirmations. Your profile and Content are public: anyone can see them in the app, and they can technically be retrieved without an account.
- You own it. Posting does not transfer ownership to us.
- You licence it to us. You grant Bananiv GmbH a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for example resize or crop) and make available your Content within nanafeed, for as long as it is on the service. The licence ends when you delete the Content or your account.
- Outside the app. We use your Content outside nanafeed (for example in app-store screenshots or on our social media) only with your separate consent, which we ask for in each case.
- Aggregated data. We may combine ratings, prices, ripeness scores, brand and store information of many users into statistics and reports (for example "average taste score of brand X in chain Y in September") and share or sell them to third parties such as retailers, importers and brands. We only publish or pass on such statistics for groups of at least 10 users, without usernames, photos, timestamps or individual entries. We do not try to re-identify anyone, and recipients are contractually prohibited from doing so.
- You are responsible for it. Post only Content you have the right to post, about products you actually bought or tasted. Do not post other people's faces without their consent, private information, or anything unlawful.
6. Prices, ratings, indices and store data
- We do not verify ratings. We do not check whether a rating, price or ripeness score comes from a person who actually bought or tasted the banana. Our automated check only confirms that a photo shows a banana. "Also tasted" is an unverified statement by another user.
- User observations. Each individual entry reflects what one user saw or tasted at one moment in one shop. It is that user's statement, not ours, and not an offer, price list or statement by the retailer or brand concerned.
- Mistakes happen. A user can mistype a price (1.59 instead of 1.79), pick the wrong store or misjudge ripeness. Do not rely on any single entry for a purchase or business decision. If you see an entry that is wrong, report it in the app; the author can edit it, and we may correct or remove it.

Rankings and indices we calculate. We calculate them automatically from user entries. Common rules for all of them: entries by Bananiv people are left out (section 1); a result is shown only when it is based on at least 5 entries from at least 3 different users; the number of entries is shown with it.
- Ripeness index of a retail chain: posts and "Also tasted" confirmations from the last 90 days, grouped by chain and country, simple average of ripeness scores (1–5), plus the share of green (1–2) and overripe (5) bananas.
- Brand and retailer rankings (statistics): ordered by a weighted taste score that pulls small samples towards the overall average — (number of posts × average taste + 3 × overall average) ÷ (number of posts + 3) — so that a few extreme ratings cannot put a brand or chain at the top. The Bananiv brand is not ranked.
These figures summarise a small number of unverified individual observations. They are not an audit, test or assessment of any retailer, brand or product.
- Map data. Store locations come from OpenStreetMap (© OpenStreetMap contributors) and may be incomplete or outdated. Apart from what is said in section 1, we have no business relationship with the retailers or brands shown unless we say so.
7. Rules of the feed
nanafeed is about bananas. Do not post: content that is not a banana or a banana product; fake reviews, ratings you did not experience, or coordinated manipulation of a brand's or store's scores; spam, advertising or affiliate links; hateful, harassing, sexual, violent or otherwise objectionable content; malware or attempts to break, scrape or overload the service. Our automated banana check may reject photos that do not show a banana; this is a technical filter, not a judgment about you.
8. Reporting, moderation and your right to challenge
- Reporting. Every post, comment and user can be reported in the app. Anyone without an account — for example a person who appears in a photo, or a company named in a post — can report content by email to maksym@bananiv.com, stating where the content is, why it is unlawful or breaks these Terms, their name and email, and that the report is made in good faith. We confirm receipt and tell the reporter our decision.
- How we decide. Reports are reviewed by a person. We act diligently, objectively and proportionately, taking into account the rights of everyone involved, including freedom of expression. Measures we may take: removing or hiding Content, restricting features, temporarily suspending or terminating an account. The automated banana check is the only automated moderation step.
- Reasons. If we remove your Content or restrict your account, we tell you what we did and why, which rule or law it is based on, and how to challenge it — unless the Content was deceptive high-volume commercial content, or an authority has lawfully instructed us not to inform you.
- Challenge. You can ask us to review any such decision within 6 months by email. Your challenge is reviewed by a person, not by automated means alone, and we tell you the result and the reasons. You may also go to court.
- Blocking. You can block any user; they will no longer see or interact with your Content.
9. AI features
The ripeness meter and banana verification use automated image analysis by an external provider (see Privacy Policy). Results are estimates provided for convenience and fun. They are not a food-safety, quality or purchase guarantee. Always use your own judgement before eating anything.
10. Our content and brand
The nanafeed name, logo, design and code belong to Bananiv GmbH. You may use the app for personal, non-commercial purposes. You may not copy, scrape, reverse-engineer (except where the law allows it) or resell the service or its data without our written permission. Store location data derived from OpenStreetMap is available under the Open Database License (ODbL).
11. Liability
nanafeed is free of charge. Our liability is therefore as follows:
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
- For slight negligence we are liable only if we breach an obligation that is essential for the agreement to work at all and that you may regularly rely on ("cardinal obligation"), and then only for the typical damage that was foreseeable when you signed up.
- Otherwise we are not liable for slight negligence.
- We are not liable for Content of other users as if it were our own. Once we obtain actual knowledge of illegal content, we act expeditiously to remove it or disable access to it (Art. 6 Digital Services Act).
- These limits also protect our employees, representatives and contractors.
Mandatory consumer protection law of your country of residence remains unaffected.
12. Ending the agreement
- You can end it at any time by deleting your account in Settings → Delete account. Your profile, posts, comments, stickers and confirmations are removed from the app immediately and cannot be restored. Remaining copies in backups, at our AI provider and in moderation records are deleted within the periods stated in the Privacy Policy, unless the law requires us to keep them. Aggregated statistics that no longer identify you may be retained.
- We can end it with 4 weeks' notice, for example if we discontinue the service. We can end it without notice, or suspend an account, for good cause — in particular serious or repeated breaches of these Terms. Section 8 (reasons and challenge) applies.
13. Law and disputes
These Terms are governed by German law. If you are a consumer living in the EU, the mandatory consumer protection rules of the country where you live also apply, and you may bring claims in the courts there. If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the courts of Frankfurt am Main have exclusive jurisdiction. We are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board under the German Consumer Dispute Resolution Act (VSBG).
14. Additional terms for users in the United States
If you live in the United States, the following applies in addition and prevails over sections 11 and 13 to the extent they conflict.
- Disclaimer. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
- Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS OR GOODWILL, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO USD 100. Some states do not allow these limitations, so they may not apply to you.
- User content. We are a provider of an interactive computer service and are not the publisher or speaker of Content provided by users (47 U.S.C. § 230).
- Copyright (DMCA). If you believe Content infringes your copyright, send a notice under 17 U.S.C. § 512(c)(3) to maksym@bananiv.com. If your Content is removed after such a notice, you may send a counter-notice under 17 U.S.C. § 512(g)(3); we restore the Content after 10 to 14 business days unless the claimant tells us it has filed suit. We terminate the accounts of repeat infringers.
- Law and courts. German law governs, and claims may be brought in the courts of Frankfurt am Main. Nothing in this section limits any right you have under the law of your state to bring claims in the courts where you live.
- California. The service is provided free of charge. Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
